WSAZ RACE FOR THE CUP RULES
NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. 1. DATES
a. The RACE FOR THE CUP CONTEST will open on January 20, 2011 at 12:00:00 AM ET and close on November 18, 2012 at 11:59:59PM
b. "Phase two submissions" will begin August 20, 2012 at 12:00:00 AM ET and close on December 9, 2012 at 11:59:59PM.
2. ELIGIBILITY RESTRICTIONS
a. The SUBMISSION SITE is open to all legal residents of Ohio, West Virginia and Kentucky who are at least 18 (eighteen) years of age or older at the time of entry and who live in the Charleston Huntington DMA counties of Boyd, Elliott, Floyd, Greenup, Johnson, Lawrence, KY, Lewis, Martin, Pike, Gallia, Jackson, Lawrence, OH, Meigs, Scioto, Boone, Braxton, Cabell, Calhoun, Clay, Jackson, Kanawha, Lincoln, Logan Mason, Mingo, Nicholas, Putnam, Roane, Wayne, WirtWEST VIRGINIA, OHIO AND KENTUCKY. This Promotion is subject to all applicable federal, state, and local laws and regulations. Void outside the United States, in NY and FL, as applicable, and where prohibited. 3. HOW TO REGISTER
a. You may REGISTER in THE RACE FOR THE CUP via the following methods:
VIA INTERNET – Follow the links and instructions on WSAZ.com to reach the RACE FOR THE CUP online contest site where you will need to register. If you have registered for one of our contests before simply use the user name and password you created the first time you registered. You may also register/login using your Facebook user name and password. Pervious users and Facebook users will be asked to confirm registration information including first name and last name, complete address, city, state, zip code, telephone number, date of birth, and a valid email address. You will be asked to create a unique user name for use in this contest and all WSAZ/Upickem contests.
VIA FACEBOOK – From the WSAZ/Facebook page you click on the “Contest” link on the left column of the page. If this is the first time that you have clicked this link you will be asked to “like” the WSAZ/Facebook page before you will have access to the RACE FOR THE CUP CONTEST LINK. Click on the RACE FOR THE CUP banner and proceed with your registration using your Facebook login as described above. Each registation via Facebook must include requested information, including the entrant’s first name and last name, complete postal address (street, city, state, and zip code), email address, telephone number, and date of birth.
This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By submission of an entry, an entrant releases Facebook from any responsibility or liability for the Promotion’s administration, prizes or promotion. You are providing entry information to WSAZ and not to Facebook.
4. HOW TO PLAY
a. Decisions of Station management with respect to the Promotion are final.
b. For each race, pick the drivers you think will finish in 1st through 10th place for the race. Picks must be submitted 15 minutes before the race is scheduled to start. Entrants will be awarded points depending on how the driver's they select finish the race. 1st place is worth 150 points, 2nd place is worth 125 points, 3rd place is worth 100 points, 4th place is worth 80 points, 5th place is worth 78 points, with the number of points being reduced by 2 points for each subsequent place from 6th place (76 points ) to 43rd place (2 points). Drivers who finish in 44th place and beyond will not receive any points. The total points for the ten drivers you selected for the race becomes the Team Score. There is a 25 point bonus for each driver that comes in the exact place you picked the driver to finish, e.g., if you picked a driver to finish in 2nd place and the driver finishes in 2nd place, you will receive a 25 point bonus to the Team Score. Your total score for the Contest will be the combined sum of your best 15 races. If you do not make your own picks in a week the computer will make picks based on your previous pick history. If there is a tie for the most points for a race, the tie breaker will be based first on which tied entrant had the most drivers picked in the correct place for the race. If there is still a tie, the entrant who picked the highest place correct will be declared the winner. If there is still a tie, the computer will randomly select a winner from the remaining entrants that are still tied after the first two tie-breakers. If there are ties for overall score, the entrant with the most points for the most recent race will be declared the winner. If there is a tie, the computer will continue comparing race points for the most recent previous races, one-by-one, until a winner is selected. If any entrant are tied for all the races, the computer will randomly select a winner from the entrants that are tied for all races. Points are awarded for the drivers, not cars. If an entrant picks a driver who qualified for race and a new driver took his/her place before the start of the race, the entrant must pick the new driver. Entrants will not receive points even though the new driver may be racing the car of the driver that the entrant selected. And, if the new driver is not in the list of drivers that can be picked then no entrants shall have the ability to pick that driver. Weekly winners are not posted until the official governing body for the race has released the official race results and any modifications to the finish order have been made. This can be anywhere from 24 to 48 hours after the conclusion of the race. Any modifications to the race results after the official race results are posted will not be considered. Limit one (1) entry per person. For internet entry, only one entry per person and one entry per email address are permitted. 5. PRIZES AND WINNER NOTIFICATION
a. Decisions of WSAZ management with respect to the Promotion are final.
b. There will be one “local” prize awarded form the poll of WSAZ Registered Players. The top points earner will receinve a Fannin Automotive Baseball hat. Approximate value $10.00. It will be mailed to the address provided in your contest registration within 4 weeks after the race that you won. Winners from the national pool of players will be notified by email. All posted results are unofficial until winners are verified. If a winner does not respond within seven (7) days of the initial notification email, the prize will be forfeited and awarded to the next highest scoring participant. Prizes won by an eligible participant who is a minor in his/her state of residence will be awarded to minor's parent or legal guardian who must sign and return all required documents. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of participants. c. There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
d. Winners (or their parents or legal guardians if under the age of majority) must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited and an alternate winner may be chosen by the contest computer of all the registered players for that race. If a potential winner cannot be contacted, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner will be disqualified and will forfeit the prize.
6. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b. Participating in the Promotion and acceptance of prize constitutes winner’s and guest’s (where applicable) permission for the Station or its agents to photograph, film and record each winner, and to use his/her name, address (city and state), likeness, photograph, voice, biographical information and/or any statements made by him/her regarding the Promotion or its sponsors for purposes of trade, publicity or promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Station in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By participating and/or accepting a prize, entrants, winners and guests (if applicable) agree to release and hold harmless the Station, its sponsor(s) and promotional partner(s), its advertising and promotion agencies, and each of their respective parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents, representatives, successors, and assigns of each of them (collectively, the “Released Parties”) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion. The Station will also require eligible Promotion winners and their guests or travel companions, if any (as well as each of their parent(s) or legal guardian(s), if winners, guests or travel companions are under the age of majority in their state of residence), to sign a liability release confirming such consent.
d. The Station, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of the Station’s web channel or is otherwise in violation of the rules. The Station further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Station’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by the Station in is sole discretion. Any attempt by an entrant or any person to deliberately damage any station web channel or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws. Should such an attempt be made, the Station reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. The Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to modify, terminate, suspend or cancel the Promotion and shall not be required to award a substitute prize.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals, or any other difficulties that may prevent an individual from sending or receiving a text message; or (iii) lost, stolen, mangled, misdirected, postage due, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of god, acts of war, natural disasters, weather, acts of terrorism or other factors beyond the Station’s control.
f. To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winner List” to RACE FOR THE CUP Winner List or Official Rules Request, WSAZ NEWSCHANNEL 3, 645 FIFTH AVENUE, HUNTINGTON, WV 25701. A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at the main studio of WSAZ NEWSCHANNEL 3, 645 FIFTH AVENUE, HUNTINGTON, WV 25701. All such requests must be received within thirty (30) days following completion of the Promotion.
7. TERMS OF USE AGREEMENT & PRIVACY POLICY
